“The Supreme Court’s decision today ignores the historical rationale for affirmative action. It directly combated racial discrimination in higher education and employment and integrated racial minorities into an American society that had largely sought to keep them divorced from the rest of the country. That attitude persists in our country, no matter how much we would like to pretend it is an artifact of our past, and Justice Jackson said it best in her dissent: ‘Deeming race irrelevant in law does not make it so in life.’ By undermining one of our best tools to disestablish systemic racism in our institutions of higher education, these six justices have opened a path for racism to further prosper.”
